1. Agreement to Terms

By scheduling, requesting, or receiving services from Fishers Power Washing (“Company,” “we,” “us,” or “our”), you (“Customer”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and Fishers Power Washing.

2. Services Provided

Fishers Power Washing provides exterior cleaning services including, but not limited to:

Residential and commercial pressure washing
Soft washing of siding, roofs, and delicate surfaces
Driveway, walkway, and patio cleaning
Deck and fence washing
Gutter cleaning and brightening
Fleet and vehicle washing

The scope of each job is determined at the time of booking and/or confirmed in writing prior to service. We reserve the right to decline any job at our sole discretion.

3. Scheduling, Cancellations & Rescheduling

3.1 Scheduling

Appointments are confirmed via phone, email, or our online booking system. A confirmation will be sent to the contact information provided at the time of booking.

3.2 Cancellations by Customer

We require at least 24 hours’ notice for any cancellation or rescheduling. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to $50. No-shows on the day of service may be charged the full estimated service amount.

3.3 Cancellations by Company

We reserve the right to reschedule or cancel appointments due to unsafe weather conditions, equipment failure, or other circumstances beyond our control. In such cases, we will contact you as soon as reasonably possible and reschedule at no additional charge.

4. Payment Terms

Payment is due in full upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit/debit cards. For larger commercial projects, a deposit of up to 50% may be required before work begins.

Returned checks are subject to a $35 returned check fee. Accounts more than 30 days past due may be subject to a 1.5% monthly finance charge (18% APR). The Customer is responsible for all costs of collection, including reasonable attorney’s fees.

5. Pricing & Estimates

All estimates are provided in good faith based on the information available at the time of quoting. Final pricing may vary if conditions differ from what was described or visible during the estimate (e.g., excessive mold, oil stains, or structural issues discovered on-site). We will notify the Customer of any pricing changes before proceeding with additional work.

6. Customer Responsibilities

To ensure safe and effective service, the Customer agrees to:

Provide clear and unobstructed access to all areas to be cleaned
Remove or secure pets, vehicles, outdoor furniture, and personal property prior to service
Inform us of any fragile materials, prior damage, or sensitive surfaces before work begins
Close all windows, doors, and vents on the property
Notify us of any underground utilities, septic systems, or drainage concerns
Ensure a water source is available on-site (standard outdoor spigot)

Failure to fulfill these responsibilities may result in delays, additional charges, or the inability to complete the job. Fishers Power Washing is not liable for damage resulting from the Customer’s failure to prepare the property adequately.

7. Property Access & Authorization

By booking our services, the Customer warrants that they are the property owner or have the authority to authorize work on the property. If you are a tenant, property manager, or acting on behalf of another party, you represent that you have obtained all necessary approvals. Fishers Power Washing will not be held liable for disputes arising from unauthorized service requests.

8. Limitation of Liability

Fishers Power Washing carries general liability insurance and will operate with reasonable professional care. However, our total liability for any claim arising from our services shall not exceed the amount paid by the Customer for the specific service giving rise to the claim.

We are NOT liable for:

Pre-existing damage, deterioration, or defects in materials (e.g., old paint, rotted wood, aging caulk)
Damage caused by loose or improperly installed materials
Damage to items not secured or removed as requested
Natural weathering, fading, or discoloration of treated surfaces
Indirect, incidental, or consequential damages of any kind

If you have concerns about the condition of surfaces prior to cleaning, please notify us before service begins. We may recommend against cleaning certain surfaces in poor condition and will document such recommendations.

9. Damage Claims

Any claims for property damage must be reported to Fishers Power Washing within 24 hours of service completion. Claims submitted after this window may not be honored. To file a claim, contact us at the information listed in Section 15. We will investigate all claims and respond within 5 business days.

10. Satisfaction Guarantee

We stand behind the quality of our work. If you are not satisfied with the results, please contact us within 48 hours of service completion. We will return to re-clean any area that does not meet our quality standards at no additional charge. We do not offer refunds for completed services, but we are committed to making it right.

11. Weather Policy

Pressure washing is weather-dependent. We may delay or reschedule jobs due to rain, freezing temperatures, or other adverse conditions that affect safety or service quality. We will make every effort to provide advance notice and offer the earliest available alternative appointment.

12. Photographs & Marketing

Fishers Power Washing may take before-and-after photographs of your property for quality assurance and marketing purposes. These photos may be used on our website, social media, or promotional materials. Property addresses and identifying personal information will not be disclosed without your express consent. If you prefer that we not photograph your property, please notify us in writing before service begins.

13. Independent Contractor Status

Fishers Power Washing operates as an independent contractor. Nothing in these Terms shall create an employment, partnership, joint venture, or agency relationship between the Customer and the Company or any of its employees or subcontractors.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising under these Terms that cannot be resolved informally shall be submitted to binding arbitration in Hamilton County, Indiana, in accordance with the rules of the American Arbitration Association. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

15. Changes to These Terms

Fishers Power Washing reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and will take effect immediately upon posting. Continued use of our services after any such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Entire Agreement

These Terms, together with any written service agreement or quote provided at the time of booking, constitute the entire agreement between the Customer and Fishers Power Washing with respect to the services provided. These Terms supersede all prior discussions, representations, or agreements relating to the subject matter herein.
